6. Transfers of Your Personal Data

6.1 Richpanel Services and Sites, and our Help Center domains are provided and hosted in the United States. If you are located outside the United States, we may transfer, and process, your personal data outside of the country in which you are resident to other Richpanel Group Companies and our service providers including to, USA, India and other such countries as we deem appropriate from time to time. These countries may not have equivalent privacy and data protection laws (and, in some cases, may not be as protective). We will protect your personal data in accordance with this Privacy Policy wherever it is processed.

6.2 Certain recipients (our service providers and other companies) who process your personal data on our behalf may also transfer personal data outside the country in which you are resident. Where such transfers occur, we will make sure that an appropriate transfer agreement is put in place to protect your personal data.

6.3 If you are a resident of the EEA, the UK or Switzerland, we will protect your personal data when it is transferred outside of the EEA, the UK or Switzerland by processing it in a territory which the European Commission has determined provides an adequate level of protection for personal data; or otherwise ensuring appropriate safeguards are in place to protect your personal data. Our Services are not intended for use by anyone under the age of 16. We do not knowingly collect personal data from children under 16.

12. Additional Information for California Residents

12.1 Scope

Except as otherwise provided, this Section 12 applies only if you are a California resident. For purposes of this section, "Personal Information" has the meaning given in the California Consumer Privacy Act ("CCPA"), the California Privacy Rights Act of 2020 ("CPRA"), and any regulations promulgated under either law, in each case, as amended from time to time.

This Section 12 does not apply to:

information exempted from the scope of the CCPA;
activities governed by a different privacy notice, such as notices we give to California personnel or job candidates; or
Personal Information we collect, use, and share on behalf of our customers as a "service provider" under the CCPA.

You have the following rights:

Right to Information/Know: You can ask whether we have collected your Personal Information. In certain cases, you can also request the following information about how we have collected and used your Personal Information over the past 12 months:
- The categories of Personal Information we have collected.
- The sources from which we collected the Personal Information.
- The business or commercial purpose for collecting, sharing, and/or selling Personal Information.
- The categories of Personal Information that we sold or disclosed for a business purpose.
- The third parties to whom Personal Information was sold, shared, or disclosed for a business purpose.
Right to Access: You can request a copy of the Personal Information that we have collected about you during the past 12 months.
Right to Correction: You can ask us to correct any inaccurate Personal Information that we have collected about you.
Right to Deletion: You can request us to delete the Personal Information that we have collected from you.
Right to Opt-Out of Tracking for Targeted Advertising Purposes: While we do not sell Personal Information for money, we use services that help deliver targeted ads (also known as interest-based ads) to you, as described in the "How and Why We Use Your Personal Data" section above. The CCPA considers our use of some of these services as "sharing" your Personal Information with the advertising partners that provide the services. You have the right to opt-out of this.
Right to Nondiscrimination: You have the right to exercise the above rights free from discrimination, as prohibited by the CCPA.

12.3 How to Exercise Your Rights

Right to Information/Know, Access, Correction, and Deletion. You can exercise any of these rights by submitting a request on support@richpanel.com or by mailing us at 1885 Cabana Dr, San Jose, CA, 95125, USA, Attention: Compliance.
Right to Opt-Out of Tracking for Targeted Advertising Purposes. You can submit requests to opt-out of tracking for targeted advertising purposes by contacting us at support@richpanel.com.
Verification of Identity. We will need to verify your identity to process your information/know, access, correction, and deletion requests and reserve the right to confirm your California residency. To verify your identity, we may require you to log into an Richpanel online account (if applicable), provide government identification, give a declaration as to your identity under penalty of perjury, and/or provide additional information. These rights are not absolute, and in some instances, we may decline your request as permitted by law.
Authorized Agents. Your authorized agent may make a request on your behalf upon our verification of the agent's identity and our receipt of a copy of the valid power of attorney given to your authorized agent pursuant to California Probate Code Sections 4000-4465. If you have not provided your agent with such a power of attorney, you must provide your agent with written and signed permission to exercise your CCPA rights on your behalf, provide the information we request to verify your identity and provide us with written confirmation that you have given the authorized agent permission to submit the request.

Civ. Code Section 1798.140(v)) and describes our practices currently and during the 12 months preceding the effective date of this Privacy Policy. Information you voluntarily provide to us, such as in free-form webforms, may contain other categories of personal information not described below. Note that:

We do not "sell" personal information as defined by the CCPA and have not sold Personal Information in the preceding 12 months.
We do not use or disclose sensitive personal information for purposes that California residents have a right to limit under the CCPA.

Richpanel Privacy Policy (Additional Disclosures)

Introduction

Richpanel (the "Company," "we," "our" or "us") values privacy. We constantly keep taking steps to improve the protection of our user information keeping everything as per the guidelines by U.S laws.

This Privacy Policy Document ("Privacy Policy") is created to make aware the users of what information we collect, the ways in which we do, what we do with that information, what information is collected by third parties & more. This is to help you see the transparency & take informed decision on how & what you wish to share with us.

By the action of accessing our website, purchasing or even trying our product, you agree to this Privacy Policy along with any additional agreement we may have with you prior or after this. If a scenario arises with conflicting terms between the Privacy Policy & these said agreements, the prevailing term would be that of the said agreement.

This Privacy Policy holds good only to the Company, its products, its practices & its direct employees. It is not applicable to other individuals, companies and/or third party services used either by the Company or the user. Information collected by company

Information that identify you like first name, last name, position, email address, phone number, login details, business email, business phone number and Company name as well as payment information such as credit/debit card details are collected by us. We also collect user-specific data as well when you use our products. We also use web tracking technologies like cookies, beacons, pixel tags, GIFs in order to service optimally & to collect information related to usage of service. This may include IP address, browser type, source website, destination page, links clicked on our website, time spent on different sections and even whether you have opened our mail & clicked on any links within that mail. In order to run the website or products efficiently we may store cookies in your computer.

How do we use the collected information

The Company may choose to use the information we collect about you to provide you the products & services you have requested. The use also covers utilisation of information for the purpose of research & analysis into your interest in the products services as well as the content offered by us or others. We may use your information to communicate & improve communication with you via email or call or messages or chats on aspects that may be of interest to you and are either being offered by us or other third parties. Richpanel, however may use any information to the extent required by law or legal process, or if in our reasonable discretion use is necessary to investigate fraud or any threat to the safety of any individual, to protect Richpanel's legal rights or to protect the rights of its entities or third parties.

Information collected by third parties

We may share the information shared by or collected from you with any of our third parties.

Third party payment vendors may collect your information to process your payment on our behalf. Similarly, third party vendors calls, emails, chats, documentations, analytics, reporting, meetings, knowledge sharing, data storage, data sharing, data processing or any other network, technical, support or marketing services may make use of your information provided to improve the quality of product or service provided to you.

We may share your data with any parent Company, subsidiaries, joint ventures, other entities under a common control or third party acquirers. We expect these other entities will honor this Privacy Policy; we may allow a potential acquirer or merger partner to review our databases, although we would restrict their use and disclosure of this data during the diligence phase; as required by law enforcement, government officials, or other third parties pursuant to a subpoena, court order, or other legal process or requirement applicable to our Company; or when we believe, in our sole discretion, that the disclosure of personal data is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of our agreements or Company policies.

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. When you visit or log in to our website, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or home address. We (or service providers on our behalf) may then send communications and marketing to these email or home addresses. We reserve the right to use, disclose and transfer non-personal data to our partners, advertisers and other third parties at our discretion.

Security of collected information

Richpanel maintains reasonable security measures to protect personal information from loss, destruction, misuse, unauthorized access or disclosure. We use standard recommended technologies to ensure your data is safe, secure, and only available to you and to those to whom you have provided authorized access. However, no website or online entity is 100% secure on the internet.

International transfer of personal data

Data shared by you may be stored in the United States or any other country in which our Company or agents or contractors or third party vendors operate in order to facilitate the Company's global operations. Even if the Company transfers your data to other countries, the privacy policy will hold true. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

California privacy rights & disclosures

Our Company does not currently respond to browser "Do Not Track" (DNT) signals or other mechanisms. Third parties may collect personal data about your online activities over time and across sites when you visit the Site or use the Service.

If you are a California resident and we disclose your personally identifiable information to third parties for such third parties' direct marketing purposes, California's Shine the Light Law (CA Civil Code Section 1798.83) allows you to request certain information from us about such disclosures. Our Privacy Policy may change from time to time, and any changes will be posted on this page, and if the changes are significant, we will provide a more prominent notice. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.

Children's policy

Company does not knowingly collect or attempt to collect any information from children under the age of 13. If you are under the age of 13, please do not submit any information on our website or our other platforms. We recommend parents and legal guardians to monitor their children's Internet usage and to contact us if they find the child has provided any personal information.

Google API Services Disclosure

Richpanel uses Google's Application Programming Interface (API) Services and Google email management integration feature to access emails from your Gmail inbox for managing them in Richpanel platform (i.e. use of your Gmail account to login and manage the emails in Richpanel platform).

Richpanel's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Your choice to opt-out

If you would like your Personal Information removed from our mailing list or database, please contact us at talk@richpanel.com. In the event of any such removal, Richpanel may retain copies of information for its archives. Also, If you decide to opt-out, we may not be able to provide certain features of the Offerings to you.
